Bail Verification and Supervision Program
Funded by and under the authority of the Attorney General.
Purpose:
To provide community supervision of individuals released on bail from custody, allowing for the option to reduce the high numbers of people being remanded into the province’s overcrowded correctional facilities.
Assist clients in dealing with any difficulties preventing them from coping appropriately with life’s challenges.
Reduce the risk of recidivism and promote a healthier lifestyle.
Bail Verification and Supervision Procedures
Referrals received from:
- Court Officers
- Crown Attorneys
- Defense Counsel
- Self
Referrals are generally made if there are concerns regarding: drug / alcohol, lack of fixed address, employment and other related counselling matters.
Eligibility Criteria:
- The accused must reside in the Niagara Region
- Be 16 years of age or older
- Display a willingness to participate in the program
- Show some motivation to make positive changes in their lives
- Candidates must have the mental capacity to understand and follow through with program expectations
- Do not accept individuals released with a surety, however will accept young offenders on an undertaking with a responsible person.
Verification Interviews:
An interview is conducted in the security area prior to the accused appearing in court, to determine suitability for the bail supervision program.
Recommendations:
A recommendation is then made to the Crown Attorney and the Referral Agent regarding the potential client’s suitability. Should an individual be released with a condition of bail supervision, they are given a business card in the courtroom and are instructed to report to the John Howard Society of Niagara immediately upon release.
Client Reporting:
- Initially the client is required to report on a weekly basis
- Once the client has demonstrated a consistent reporting pattern and are following through with recommendations, frequency of appointments are then adjusted accordingly
- During each reporting session, conditions of bail are reviewed and compliance to all conditions monitored
- Clients are reminded of all upcoming court dates
- Practical counselling is provided at this time and everyday problems are dealt with as they arise
- Clients are often assisted in obtaining Legal Aid or Social Assistance
- Referrals to recommended programs are monitored and verified
Breach Information:
Should an individual violate his / her terms of release, it is the responsibility of the Bail Counsellor of the John Howard Society to issue a Police Advisory; so that the police may lay a “Failure to Comply” charge.
Trial Reports:
A trial report is prepared on all clients and summarizes the client’s activities during the supervision period
The case is followed through until a Disposition is reached, and then the case is closed.
