Adult Diversion Program
What is the Adult Diversion Program?
The program is a voluntary option offered by the Crown Attorney’s office for those accused of minor offences.
Who Qualifies for Participation:
It is the decision of the Crown Attorney’s office whether to grant the individual the opportunity to participate in the Adult Diversion program. This decision is based on the severity of the offence and the nature of any prior police contact.
Program Summary:
For successful completion, there are two components to this program:
1) Restitution: It is the responsibility of the accused to make restitution to the community by completing the agreed upon community sanctions. This may include cost of any damage done by client, letter of apology, charitable donation and/or community service work.
2) Program Fee: This is a fee-for-service program.
Program Objectives:
- To intervene in a positive manner with the offender, with the goal of encouraging the avoidance of further criminal activity.
- To provide the opportunity for offenders to avoid obtaining a criminal record while still being held accountable for their actions.
- To involve the offender as an active participant in the diversion process through the negotiation of sanctions.
- To benefit the community through various measures; e.g. charitable donations, community service work.
- To lessen the burden of large caseloads on the court system by diverting specific offenders from the normal court process.
- To alleviate the use of community resources. e.g. courts, Legal Aid services and the Police.
Outcome:
Upon successful completion of the program, the charges will be withdrawn resulting in no criminal record in Canada.
